    Welcome to every parent's worst nightmare.

    James Rutherford is an interesting case. Ol' Jimmy wanted to fight the conviction to start out with, so he hired a lawyer and there was a preliminary hearing. The lawyer, apparently no fan of research, asked a question at the evidence suppression hearing that any actual reader of the website would laugh at.

    Here is his question regarding our arrests, as recounted by our volunteer:
    "In fact, as far as you know, this has never been tested before, has it?"

    Uh. Yes. Many times.

    After James witnessed another episode of "Defense Attorneys Say the Darndest Things" and lost the evidence suppression hearing, he decided that he didn't wish to go to a full trial. Probably a good decision. He pled guilty and received the following...

    -45 days in Darke County Jail
    -40 hours of community service
    -2000 dollars in court costs and fines from his failed suppression hearing
    -No contact with minors ever.
    -No porn by any means.
    -No drugs.
    -No alcohol.
    -Must submit a DNA sample.
    -36 months of community control (parole) after he gets out (an extra year than other cases there) - if he violates the terms or breaks any Ohio laws he goes straight to the Ohio State Pen for 9 months.
    -The judge ordered indefinite sex offender counseling due to the poor results of his court-ordered psychological sexual offender evaluation.
    -Sex offender registration for life in Ohio, reporting for 10 years.
    -His teaching certificate in Ohio has been revoked.
    -He is facing 7 additional felonies in Indiana for chatting with and wanking for a Detective there that he was talking to at the same time as our volunteer. He will face those when he gets out of Darke County Jail.

    I have been waiting for this conviction for a long time.

    In middle March of 2006 I was trolling the Ohio area chat rooms for a sting to be conducted by the Darke County Sheriffs office and filmed by Dateline To Catch a Predator. I was contacted by James Rutherford and the chat itself was pretty boring until he identified himself as a 6th grade Catholic school teacher. That sure got my attention and I thought to myself "if he is chatting what is he doing to his students?". He went further and told me he also coached girls track at the school, putting him in an even closer relationship to young girls.

    Mr. Rutherford was a married man at the time he chose to show up to molest a 13 year old girl, however his wife left him just a few days before then, perhaps she knew of his tendencies. As part of his sentencing he had to undergo a psycho sexual evaluation and the Doctor uncovered so many "icky" things that Mr. Rutherford will be under the care of a therapist for a very long time. After he was arrested and the TCAP aired the mother of one of his students called the Darke County Sheriffs office to thank them. It seems Mr. Rutherford had been grooming her 6th grade daughter, she was so weirded out by him she did not even want to go into his class and would never go in there alone.

    He proclaimed to Chris Hansen when he sat for a very long interview that as he aged the girls he was attracted to did not. He also said he did not think he was a predator. Mr. Rutherford not only hit on my decoy profile during this sting, he hit on a few other contributors as well as a Detective in Indiana. He still faces seven felonies in that state for those chats once Ohio is done with him. He will be in jail for a long time.

    I am very glad that he will not have access to minors anymore and that those around him have been put on notice so they can protect themselves from this seemingly innocent looking, yet dangerous vile individual.


    This is our 175th conviction since June of 2004 and our 54th conviction for 2007 so far.
